Clarence Wallace Woodward was tried in his absence Tuesday in General District Court on defective equipment, failure to prevent escape of the contents of a vehicle and driving a vehicle with a load in excess of the allowed gross weight.
Trooper C. R. Moore said that he noticed the truck and that a substance was blowing off of its load so he stopped the vehicle. Trooper Moore said that he had scales with him, and he weighed the truck and found that it was over the weight limitations.
Judge John Alexander assessed a $25 fine for the defective equipment charge, a $25 fine for failure to prevent the escape of the contents, a $25 fine for the truck being over the gross weight allowed and $25 costs. Judge Alexander also assessed $494 in liquidated damages in the case. Liquidated damages are determined by multiplying a set charge for each pound over the weight limit by the number of pounds. Woodward was also charged a $2 weighing fee.
