OF VALUABLE REAL ESTATE

Under and by virtue of the authority vested in the undersigned Trustee under that certain Deed of Trust from STUART PROPERTIES, a Virginia Partnership, to James W. Fletcher, Trustee, recorded in Deed Book 165, at page 146, among the land records of the County of Rappahannock, State of Virginia, default having been made in payment of the indebtedness thereby secured, and the Grantors being otherwise in default hereunder, and having been directed by the holder of the note so to do. the undersigned will, on

FRIDAY, SEPTEMBER 9,1968,

at 10:00 A.M. (EOT) at the front door of the Courthouse of the County of Rappahannock, in Washington, Virginia, offer for sale at public acutron to the highest bidder, the property mentioned in the aforesaid Deed of Trust situate in the Town of Washington, Rappahannock County, Virginia, more particularly described as follows: '

‘All that certain tract or parcel of land with improvements thereon fronting on Route 622 and Main Street, in or near the Town of Washington, Rappahannock County, Virginia, containing 11.2739 acres, as shown on plat of survey of the Lucy M. Stuart Estate by Rappahannock Surveys, Inc., Wayne E. Niskanen, C.L.S., dated March 4, 1975. which plat is recorded5* Plat Book 4. page 29 of the Rappahannock Cbunty, Virginia land records.

AND BEING the same property acquired by Stuart Properties by deed from Douglas K. Baumgardner, et als.. Special Commissioner, dated April 1.1985. and recorded April 3,1985, in Deed book 151. page 539 of the land records aforesaid. LESS AND EXCEPT the following: All that certain tract or parcel of land containing 1.5000 acres, more or less, with improvements thereon, situated on State Route 622 in the Town of Washington, Rappahannock County, Virginia, Hampton District, and designated as Parcel 2 on plat and survey of VH&D, Inc., dated September 23,1986, which is attached to that certain deed from Stuart Properties to Robert T. Parrish and Susan M. Parrish dated September 26, 1986, recorded in the land records aforesaid.'

The property described herein is known as tax parcel number 20A-1, Lots 15.16.17 and 21.

This sale is also subject to the covenants, conditions, restrictions, rights-of-way, easements, rights, by-laws and regulations, if any, contained in the deeds forming the chain of title to the above property. This sale is further subject to mechanic’s and materialmen's liens of record and not of record and to prior mortgages, deeds of trust and other encumbrances of record.

Information as to the status of record title and the improvements on the above described real property and all documents available to the Trustee may be examined by prospective purchasers at the offices of the Trustee on Monday through Friday, inclusive, or each day (exclusive of legal holidays) between 2:00 P.M. and 4:00 P.M.

A deposit of ten percent of the successful bid (cash or certified or cashier's check) will be required of the successful bidder at the time of sale with the balance due at settlement, which shall be held on or before ten (10) days from the date of sale. Time shall be of the essence with respect to settlement. The deposit shall be applied to the credit of the successful bidder at settlement: or in the event of the failure to complete settlement, within ten (10) days after the date of the sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to the costs of sale, including Trustee's fees, and the property shall be resold at the cost and expense of the defaulting purchaser. The balance of the purchase price shall be in cash or its equivalent at the time of settlement. The subject property and any improvements thereon shall be sold in ‘as is' condition without warranties of any kind. Real estate taxes shall be adjusted as of the date of sale. The conveyance shall be by Special Warranty and the Grantor's tax and cost of preparing the deed shall be the expense of Seller. Examination of title, other recording charges, notary fees, settlement fees will be at the cost of the purchaser.

The Trustee reserves the right: (i) to waive the deposit requirement; (ii) to extend the period of time within which the purchaser is to make full settlement: (iii) to withdraw the property from sale at any time prior to the termination of the bidding; (rv) to keep the bidding open for any length of time; (v) to reject all bids; (vi) to postpone or set over the date of sale; and (vii) to determine the order of sale at the time of sale. In the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, such notices of postponement or setting over will be in a manner deemed reasonable by the Trustee.

Written notice of this Trustee's sale, as required by Title 55, Section 59.1 of the 1950 Code of Virginia, as amended, hasbeen given to Stuart Properties, a Virginia Partnership, to F. Bruce Corneal. Jr.. General Partner, to Comeal Development Company, Inc., General Partner, and F. Bruce Corneal, Jr., individually, by certified mail at the last known addresses as they appear in the records of the Noteholder.
