ORDINANCE

ORDINANCE WHEREAS, section 29.1-526 of the Code of Virginia, 1950, as amended, provides that the governing body of any county may, by ordinance, prohibit the hunting with a firearm, of any game bird or game animal on or within 100 yards of any primary or secondary highway in such county, and may, in such ordinance, provided that any violation thereof shall be a misdemeanor; and WHEREAS, the Board of Supervisors of Rappahannock County as the duly constituted governing body for the County of Rappahannock, Virginia, deems the enactment of such ordinance to be appropriate and proper. ORDINANCE NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS TO-WIT: That the hunting with a firearm of any game ( bird or game animal on or within 100 yards of any primary or secondary highway in the County of Rappahannock, Virginia, is prohibited, and any violation hereof shall be punishable as a Class II misdemeanor. The term "hunt” shall not include the necessary crossing of a highway for the purpose of going into or leaving a lawful hunting area. The Clerk of the Rappahannock County Board of Supervisors is hereby directed to notify the Director of the Department of Game and Inland Fisheries by registered mail of the enactment of this ordinance and to provide him with a certified copy of this ordinance prior to 1 May, 1989. This Ordinance shall become effective on 1 January 1989 and at that time the Ordinance adopted by the County on 5 April 1982, prohibiting hunting or attempting to hunt within 100 yards of a state road shall be deemed repealed and superceded by this ordinance, but until «jch time, the ordinance of 5 April 1982, shall remain in full force and effect and the violation thereof and shallbe deemed a Class II misdemeanor.
