In fact, a scholarly finding that a building or property is “eligible” for the National Register of Historic Places doesn’t “take” one bit of private property right.
What it does is trigger special review of federal spending or other action (e.g. federal permits) that would destroy the historic values that make a property register-eligible. An organization with which Mr. Menks is connected, Citizens for Land Rights, says, “Every American has a right to use federal monies and receive federal permits and licenses” - in other words, the right to use our tax money to destroy part of our heritage.
That’s what Rep. Allen’s bill is all about; it would allow local governments to “veto” a finding of Register-eligibility, thereby opening the door to use of our tax money to destroy parts of our heritage without justification.
