Moreover, those currently on death row who were convicted prior to the emergence of DNA testing as a standard should have the opportunity to have any existing evidence tested as well. It is the state’s responsibility, and ours as its citizens, to ensure that every reasonable piece of evidence is examined before carrying out a sentence of death.
Virginians certainly saw the efficacy of this method in the case of Earl Washington Jr., who was sentenced to die for a rape and murder that DNA tests show he did not commit. It’s fortunate that this mistake was rectified. With modern DNA testing technology, this mistake could have been avoided altogether.
