As a result of a state Supreme Court ruling, many counties in Virginia are no longer approving variances to property owners whose building plans do not conform to code.

And it may not be such an easy process to get a variance in Rappahannock County any longer, but this is a decision that will take some serious debate.

“There will be a long period of figuring out what is on the ground and who will make the decisions, the local government or the courts,” said County Administrator John McCarthy.

At the same time, the Rappahannock County Board of Zoning Appeals has asked McCarthy to draft a letter to Rappahannock realtors to clarify the standard for the issuance of variances in the county.

What triggered the letter, in part, was testimony from persons who came before the BZA seeking a variance who said their realtor told them getting a variance from the BZA was no problem.
