Having been on the county Board of Zoning Appeals for the past 12 years, Jennifer Matthews said that it has been the practice of the board to generally issue modified variances after going out and actually taking a look at the property in question.

By approving modified variances, this allows the board to maintain a situation where it is “almost in conformity of the stated setbacks,” said Matthews.

Long-time area realtor Mitzie Young was surprised to hear about the court ruling, an issue that has not been addressed, to her knowledge, by the local realtors. “I am going to classes in December and hope this is going to be covered. This is really important in what we advise our clients.”

Recent Virginia cases relating to variances were on the agenda for the Rappahannock County Board of Zoning Appeals meeting scheduled for Dec. 1, after the Rappahannock News had gone to print, as was a review of McCarthy’s draft letter to realtors.
