On June 19, Zoning Administrator Evan McNear obtained a warrant for Sperryville antique dealer P. E. Steve DeMent, charging DeMent with failure to obtain a building permit for a structure costing $500 or more.
The action came after a June 15 deadline set by the Board of Zoning Appeals passed without DeMent modifying his new building so that it complies with the special use permit originally issued for its construction.
DeMent’s building permit was revoked by the BZA in June, 1977. The revocation was subsequently upheld by Circuit Court Judge Rayner V. Snead in August, 1978. In a letter dated May 15, 1979, the BZA notified DeMent that the addition to his antique business was an “unlawful structure” and must therefore be modified to meet requirements set forth in the original special use permit.
The permit issued in April, 1977, stipulated a 70-foot by 40-foot addition built as an extension of the existing building. According to the BZA, if a 70-foot long addition had been constructed
