—What is your position on the Freedom of Information Act as it applies to work sessions attended by less than three members of a governing body? Are these meetings with less than a quorum present covered by FOI and open to the public?

Baumgardner: I believe that where there is any doubt in regard to the application of the Freedom of Information Act it ought to be resolved in favor of compliance with the Act. The penalty for non-compliance is relatively severe and I feel that from a policy standpoint, the governing bodies of Rappahannock County would be well advised to comply with the Freedom of Information Act where ever a doubt arises.”
