persons will constitute a nuisance to neighboring property owners and maintains that this condition is also unenforceable since there’s no way to determine who is on the nine-acre premises for the purpose of attending services and who is there for other reasons.
As the conditions impose no limits on the number of campers, mobile homes or recreational vehicles that may be on the NPEA property, there is no way to make a determination on compliance with health department regulations as required in the variance, according to the suit.
Currently, the NPEA has a health department permit for a sewer system with a 960 gallon septic tank listed as serving a church. According to a health department official. this system is adequate for a congregation of approximately 40 persons, meeting for hour-long services once or twice a week.
Under the latest available health department regulations, sewage must be held in a septic tank for a minimum of 30 hours before dispersal through a drain field. This means that N PEA’s 960 gallon tank has a capacity of 32 gallons per hour, an average of four toilet flushes. (The standard toilet uses eight gallons of water for each flush.)
Using the health department's institutional rate of 50 gallons per day per person and figuring on 400 people, the number that attended last year's NPEA camp meeting, the facility should be served by a septic tank with a capacity of approximately 24.000 gallons. The cost of that size tank will run approximately $50,000. based on standard estimates of $1 per gallon of capacity and $1 per gallon for installation. With the best soil, a drainfield needs 52 square feet for every 100 gallons of flow, requiring a drainfield for the NPEA facility of approximately one-half acre.
A hearing date on the request for a review and stay of the BZA’s action in granting the campground variance has been set for Friday. June 13. at 10 a.m. in Rappahannock Circuit Court.
