Requiring a property owner with residentially-zoned land to secure a variance before building a home is not logical. Single family dwelling units should be allowed by right on land designated for residential development. But the integrity of the zoning ordinance shouldn’t be jeopardized by ignoring legal requirements that it contains. The question may be raised, and rightly so, as to whether the county isn't guilty of arbitrary and capricious application of its. own laws by picking and choosing which zoning regulations to enforce.

As soon as the error was first noticed, it should have been corrected by an amendment to the ordinance, allowing single family dwellings by right in RS1. The failure of the planners and supervisors to take this action may have serious complications further down the road.

We urge the men responsible for Rappahannock's land use ordinances to address this problem immediately. It’s long past time for a review and revision of our zoning and subdivision law.
