Holmes Estate
A temporary injunction request from David Konick was denied by Robertson who declined on Monday to order the executor for the estate of Col. Earl Edward Holmes of Flint Hill to cease paying attorneys from its SI.5 million assets.
Konick reported that lawyers George Davis, Peter Luke and Roland Hartshorn are being paid on an hourly basis from the estate by Peter E. Nielson who is both executor and sole beneficiary. He noted that counsel fees can only be paid from an estate with permission of the court.
Konick maintained that it would be improper for the court to give that authorization until pending legal action settles the question of whether Nielson exerted undue influence or perpetrated fraud in persuading Col. Holmes to execute the contested will. He asked for a temporary injunction barring Nielson from paying counsel fees relating to the contested will
