Buntin's suit citing these two alleged discriminatory and unconstitutional acts was filed July 7, 1981. “As a result, this action is barred by the applicable Virginia two-year at statute of limitations,” lawyers maintain.

According to the motion to dismiss actions of the trustees were in compliance with state law and although Buntin alleges discrimination on the basis of age and violations of due process and equal protection in his suit, the defendants are “immune from liability as a result of the good faith performance of their duties.”
