Involved in a one-car accident, Turner initially told State Trooper A. J. Newhn that he was driving the vehicle that hit a guardrail just west of Country Manor at Beach Springs.
During his testimony before the court, Turner told Commonwealth’s Attorney Peter Luke that the actual driver of the car at the time of the incident was an employee of Turner's who wasn't registered with Turner’s insurance company. Turner said he bed to Newhn to avoid trouble with

Luke, in Ms closing arguments to the court, stated that for Turner to have had only two beers at lunch as Turner stated, and register a .10 blood alcohol level right hours later was evidence that Turner’s credibility left much to be desired.
Turner said a man by the name of Lawson drove the truck into a guardrail to avoid hitting another truck that was on the wrong side of the road, “straightening out the curves. ” Judge Alexander believed Turner and found him not guilty.
