The Authority heard from several residents who were certain that their septic tanks were not malfunctioning. “No one helped me pay for my septic tank,” said one resident who did not identify himself. “I’m not going to help pay for anyone else’s.”
Doug Baumgardner, attorney for the Authority, explained that the land acquisition procedure involved two categories. One, the main collection (sewer) line, which includes only a few parcels of land. No landowner, he said, could be required or compelled to allow a main line on his property.
The second category is quite different, he said. It includes the lateral lines and septic tank installation. Everyone in the project area identified by the health department and State Water Control Board must hook on to the system.
“The ordinance provides that individual landowners can be required to hook on,” Baumgardner said. He added that the residents who do sign a user agreement prior to construction do not pay a hook-up fee.
