The Board of Zoning Appeals voted last week to turn down the application of the Child Care and Learning Center fin* a variance from the rear setback requirements of the toning ordinance.

The Center had come before the Planning Commission twice and the BZA once before appearing July 26 at the regular monthly meeting of the BZA.

Chairman Lee Bird addressed the BZA before its discussion of the Sursum Cords ease. He said the request centered around the issue of hardship, a condition that could be found for several reasons and in degrees of severity.

Hardship is defined in Virginia law as “hardship approaching confiscation,” “undue hardship,” and “unnecessary hardship.” Hardship must exist through no fault of the application—because of features of the land itself.
