Planning commissioner David Fanning told the ministers that he did not see where the proposed ordinance would interfere with the right to worship. “The ordinance would control only the building, and if we had no special use permit requirement then we would have no control over what could be built,” said Fanning.
Planner Dick McNear said that the provision in the ordinance was designed to restrict the way a place of worship operates only in regard to the rights of neighbors to the quiet enjoyment of their property. “A Board of Zoning Appeals hearing on special use permits is not a popularity contest,” said McNear. “Whether the Board members like a request or not doesn’t matter because if the standards for a permit are met then the permit would have to be issued.”
