taking Rappahannock to court over a zoning dispute where the county is trying to keep the developer out. Rappahannock’s case in court would be hurt if the developer referred the judge to the county’s records, which would reveal a pattern of non-observance of the zoning and subdivision ordinance.
That is Konick’s point, and that is why he says his is an unpopular position - because the zoning administrator must be concerned with setting a consistent record of precedent. He cannot grant an exception merely because a person wants it badly; the law mus support it.
The benefit of good precedent may not be seen at all today, but it could very well defend the county against an invasion of developers tomorrow. This is something to think about.
