“Zoning ordinances are recognized as valid exercises of police power as long as they are not arbitrary or unreasonable,” Judge Robertson wrote in his letter opinion. In ruling against the county, he found arbitrary and unreasonable (as they apply to Mr. Croston and Mrs. Moore) the ordinance provision cited above and a section which requires nonconforming structures extended, enlarged or relocated to conform with the ordinance.

Mrs. Moore expressed satisfaction with the outcome but dissatisfaction that she had to go to court in the first place. “It cost me to defend myself against this county,” she complained. “They wouldn’t listen to me that my trailer park is a nonconforming use,” said Mrs. Moore, who is the widow of one Fairfax attorney and now employed as secretary by another.
