shall be provided within the subdivision. Whether that means inside the subdivision, or just along the public street is unclear, he added, but it does require streets, sidewalks and gutters. And, he added, there is no minimum subdivision size below which the requirements are waived.
Mr. Wickens told Rev. Scott that the planning commission intends to revise the ordinance to eliminate some of those provisions, but as it is written, “there are a lot of ‘shalls’ and very few ‘mays’.” That, he added, gives the planners little leeway to waive provisions they deem unnecessary.
Mr. Reynolds explained that the requirements for streets, sidewalks and gutters were written into the ordinance because, in the past, “people came in with a subdivision and said, ‘I will dedicate this,’ and it never happened. Then, the property changed hands and the dedicated property was needed and it was not there.”
Under the ordinance, Mr. Reynolds told the planners, Rev. Scott is required to dedicate a 15 foot wide strip of property which would be used to upgrade the street to a 50-foot right-of-way.
