WASHINGTON, D.C. — Seventh District Congressman - D. French Slaughter, Jr., took the House Floor and urged his colleagues to join him in supporting a constitutional amendment to protect the American Flag. “Earlier we were unable to vote for a constitutional amendment and had only the option of voting for a statute prohibiting flag desecration. Many of us anticipated that the Supreme Court would rule as it did yesterday. Now we must move forward with the constitutional amendment,” stated Slaughter. The Supreme Court in a 5-4 decision struck down the Flag Protection Act of 1989, declaring it was unconstitutional and abridges first amendment rights.
In his statement delivered on the House Floor Slaughter said “Now that the Court has found the ‘flag burning’ statute unconstitutional, this body must move forward to protect our flag. The flag, as our national symbol representing the ideals and freedoms for which Americans have fought and died for over 200 years, deserves special protection.”
One year ago, in June 1989 the Supreme Court issued a decision in the Texas V. Johnson case which held that the burning of the American flag is a form of “expression” protected by the First Amendment. On October 18, 1989 the Congress passed the Flag Protection Act. Slaughter reluctantly supported the statute, believing that a constitutional amendement would be required to protect the American flag from violent desecration.
