Being the same land devised to Charles Henry Kilby and Russell Lee Kilby by will of P.M. Finks, also known as Pascal Menefee Finks, dated February 7, 1969, and recorded August 16, 1971, among the fend records of the Circuit Court Clerk's Office Of Rappahannock County, Virginia, in Will Book Y, at Page 500. The sale of this property is subject to all easements, rights of way and restrictions which may be of record.

TERMS OF SALE: Cash with a successful bidder's deposit of $1,000.00 in cash or certified check at time of sale and balance upon tender of Special Warranty Deed, settlement to be held within twenty (20) days from the dais of sale in the offices ofe^^n, Yeaman & Mod Davis Street Virginia.

In the event of resale, the deposit shall be forfeited by the defaulting purchaser and applied to the costs and expenses of the sale and the balance, if any, to be retained by the Trustees as compensation for said sale. Examination of title, conveyancing, and recording fees shall be at the expense of the purchaser. Purchaser shall assume any unpaid taxes for the current year subsequent to the date of sale. Sale is subject to any valid filed or unfiled mechanics' liens, if any, and any other matters of record recorded prior to the aforesaid Deed of Trust.
