NOTICE OF SALE
Pursuant to a decree of the Circuit Court of Rappahannock County, Virginia, made and entered on the 4th day of February, 1993, in the partition suit brought by Lottie V. Dozier and others against Georgia Proctor and others, we will on Friday, the 7th day of May, 1993, at the front door of the Courthouse of Rappahannock, County, Virginia, at 11:00 o'clock a.m. of that day, offer for sale to the highest bidder, the following described real estate: All of that certain tract or parcel of land lying on the east side of Battle Mountain about one mile west of Viewtown in the Jackson District of Rappahannock County, Virginia, and containing 57.347 acres, as the same is more particularly descirbed according to plat and survey of James W. Cubbage, Jr., Certified Land Surveyor, dated January 7,1992. Said property is adjacent to the lands of Woodward, Dixon, Lauer, Fannon, Williams, and Printz. Said property is the same real estate conveyed to Henry Lee and Mary Ellen Lee, husband ana wife, and Paul Lee, by deed of Henry W. Spilman and Alice E. Spilman, dated August 27, 1912, and recorded amongst the land records of the Clerk’s Office of the Circuit Court of Rappahannock County, Virginia, in Deed Book Z, at page 304.
Terms of sale: A bidder's deposit of $15,000.00. said deposit being due and payable on the date of sale in cash or equivalent funds, with the balance of said purchase price being due and payable, in full, thirty (30) days from the date of sale. THE SALE IS SUBJECT TO THE APPROVAL OF AND CONFIRMATION BY THE CIRCUIT COURT OF RAPPAHANNOCK COUNTY, VIRGINIA. Settlement and compliance with the terms of sale to be had and complied with within thirty (30) days of the date of sale. In the event of default by the purchaser, the Court reserves the right to declare a forfeiture of the deposit, keep the deposit, and re-advertise and resell the property at the risk and cost of the defaulting purchaser.
The Special Commissioner makes no representations as to the physical characteristics or condition of any improvements located on the property. Prospective bidders are encouraged to inspect the property prior to the date of sale. The property is to be sold subject to all covenants, restrictions and easements of record.
