As you know, the staff of the
Joint Committee on Taxation recently issued a report that included suggestions for drastically reducing the federal tax benefits of the donation of conservation easements. We are writing to explain why we believe proposals to limit the tax deductions for donation of conservation easements should be rejected. We are residents of Rappahannock County, Virginia and members of the Board of Directors of the Rappahannock County Conservation Alliance (RCCA). Rappahannock County’s Comprehensive Plan declares that it is a “scenic, rural county”, and we believe that in this it is unique among counties in Virginia and perhaps in the United States. RCCA is a charitable and educational organization whose purpose is to promote the preservation of the scenic and rural character of the county by protecting agriculture and promoting the permanent preservation of open space.
In RCCA’s experience, the most effective means for preserving the rural character of our county has been to urge and persuade landowners to donate permanent conservation easements on their properties. By doing so, landowners are able to restrict subdivision and development of tracts of undeveloped land in perpetuity, hoping to preserve the scenic and rural character of our county as it is today.
