Because of this and numerous other issues, our SENATE (per Art. II, Sect. 2) refused to ratify these accords, under both this and the Clinton Administration, and therefore Kyoto is a piece of paper with no standing in this country. It would be a violation of our Constitution to implement Kyoto; THAT would be an impeachable offense!
The same discussion applies to her complaint about the World Court: do not blame the President, because it is still Congress who is saving us from that disaster.
This Administration has determined that the Guantanamo detainees are not Enemy Soldiers and therefore not subject to the Geneva Convention. They present an ambiguous legal conundrum, which will have to be worked out balancing our protection and our moral principles; there is no easy instant answer.
