The trial of Samuel A. Marvin, a Sperryville man accused of sexually assaulting a six-year-old girl, has been delayed until November. Marvin’s court proceedings were originally scheduled to start the morning of August 22 but his attorney Mark Williams filed an emergency motion on August 18 asking for a continuance on the grounds that his client was not competent to assist Williams in his defense. Williams told the Rappahannock County Circuit Court that he nad visited Marvin prior to the trial date and found the defendant acting strangely and refusing to talk about the case.
“In order to be competent to stand trial, you have to be able to understand the charges against you, and you have to be able to assist your attorney with your defense,” explained Commonwealth’s Attorney Peter Luke.
The Court granted the defense’s motion on August 21, and ordered a competency evaluation for Marvin, the results of which will be presented to the court on November 28.
Marvin was originally arrested on April 7 by the Rappahannock County Sheriff’s Office. He is charged with aggravated sexual battery to a victim under age 13 and taking indecent liberCounty
