The Planners reached no decision after their hearing and asked the Supervisors for more time in which to study the proposed amendments before recommending approval or denial. Although the Virginia Code allow s local Planning Commissions 90 days in which to consider ordinance amendments, the Supervisors gave their advisory group only six days and despite the Planners' request, refused to extend the time limit. Instead. the Supervisors adopted the proposed amendments by majority vote at their September 7 meeting without a recommendation front the Planners.
(According to Delegate George Beard, the state Attorney General was asked 2 weeks ago to rule on the legality of the Supervisors' action as it relates to Coderequirements giving Planning Commissions 90 days in which to act.)
In addition. Olson maintains in his letter to the Board of Supervisors that the language of the county's zoning ordinance is indefinite and too vague to be legally enforceable. Also, according to the environmental attorney, the new amendments to the zoning ordinance are "inconsistent factually and philosophically with other sections of the ordinance designed to protect the steep slopes in conservation areas."
