This action seeks to partition among the heirs, assignees' and successors in interest of Frank Fitzhugh and Jennie Fitzhugh, the real property which Frank and Jennie Fitzhugh owned at death. This real property consists of two adfoining tracts situated along Route 211 in the Piedmont District of Rappahannock County, Virginia, containing 4.64 acres and 5 acres, respectively.
An Affidavit having been filed stating there are nonresident Defendants, and it appearing from the Bill of Complaint that there may be Defendants whose names are unknown, and who are made Defendants under the description "Parties Unknown", it is Ordered that the above-named Defendants and Parties Unknown, who are all heirs, assignees or successors in interest of Frank Fitzhugh or Jennie
