PUBLIC NOTICE Pursuant to Section 15.1-431 of the Code of Virginia, 1950, as amended, notice is hereby given that the Board of Supervisors of Rappahannock County will consider the following proposed ordinances at its meeting on Monday, April 5, 1982, at 10:00 o’clock A M. in the Courthouse, Washington, Rappahannock County, Virginia:
ORDINANCE #1
WHEREAS. Section 29-231 1 7 of the Code of Virginia 1950. as amended, provides that the governing bodies of all counties in the Commonwealth of Virginia may. in their discretion, prohibit the running at large of all or any category of dogs in all or any designated portion of such counties during such months as they may designate, and
WHEREAS, for purposes of prohibiting the running at large of such dogs a dog shall be deemed to be running at large while "roaming, running or self-hunting off the property of its owner or custodian and not under its owner's or custodian s immediate control ’"
NOW. THEREFORE. BE IT ORDAINED AS FOLLOWS. TO-WIT That, pursuant to Section 29231 1 7 of the Code of Virginia. 1950. as amended, the running at large of all dogs in all portion of the County of Rappahannock Virginia be. and same hereby is. prohibited For the purpose of this ordinance, a dog shall be deemed to be run at large while roaming, running or self-hunting off the property of its owner‘or custodian and not under its owner s or custodian's immediate control Any person who permits his dog to run at large shall be deemed to have violated the provisions of this ordinance
ORDINANCE #2
WHEREAS. Section 29-1 44 5 of the Code of Virginia. 1950. as amended, provides that the governing body of any county may. by ordinance prohibit the hunting or attempting to hunt with a firearm, of any game, bird or wildlife animal while the hunting or attempting to hunt is on or within 100 yards of any primary or secondary highway in such county, and may. in such ordinance provide that any violation thereof shall be a misdemeanor. and
WHEREAS the Board of Supervisors of Rappahannock County, as the duly constituted governing body for the County of Rappahannock Virginia, deems the enactment of such ordinance to be appropriate and proper
NOW THEREFORE. BE IT ORDAINED AS FOLLOWS. TO-WIT That the hunting or attempting to hunt with a firearm of any game, bird of wild animal while the hunting or attempting to hunt is on or within 100 yards of any primary or secondary highway in the County of Rappahannock. Virginia be. and it hereby is. prohibited within the County of Rappahannock. Virginia
For the purpose of this ordinance, the term "hunt" or "attempt to hunt" shall not include the necessary crossing of such highways for the bona fide purpose of going into or leaving a lawful hunting area
The Clerk of the Rappahannock County Board o Supervisors is hereby directed to notify the Executive Director of the Commission of Game and Inland Fisheries by registered mail no later than 1 May. 1982. of the enactment of this ordinance and to further provide the said executive Director of the Commission of Game and Inland Fisheries with a certified copy of this ordinance on or prior to May 1. 1982
The aforesaid ordinance is available for public examination at the office of the Clerk of the Board of Supervisors of Rappahannock County between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday
All persons affected by the aforesaid ordinance may appear at a hearing in the Rappahannock County Courthouse at 10 00 a m on April 5, 1982 to present their views. Diane Bruce cl#rk
