eery store where she saw the red truck. Jenkins’ attorney, George Freeman, asked Nicholson where Jenkins was when she stopped at the store. “He was already in the store,” Nicholson said.
Freeman made a motion to strike the charges since, he said, “No one can identify Mr. Jenkins as being the driver."
Commonwealth’s Attorney Peter Luke argued that there had been testimony identifying Jenkins as the truck’s driver, but Judge John Alexander disagreed. “My understanding of the testimony is different from the court’s,” Luke said.
Judge Alexander granted Freeman’s motion to strike and dismissed both charges. Jenkins was also charged with refusal to take a breathalyzer test, but that case was continued to Dec. 10.
