“It’s a historic day for the Town of Washington,” said Mayor Dean Morehouse. “For the first time in its history it's being used - and by the local doc- , tor. We’re not immune, we’re finally in the‘80s.”
The suit, filed by Dr. Werner Krebser in Rappahannock County Circuit Court last week, alleges that the Town Council “acted in bad faith” in issuing a special use permit to Rae Haase. She requested the permit to operate a gourmet specialties and natural foods store in a house formerly owned by Barbara Wood, across Gay Street from Trinity Church.
Dr. Krebser has an interest in the adjoining property, which houses the county’s social services offices and the Rappahannock Medical Center.
His suit asks the court to grant temporary and permanent injunctions against the use of the property for commercial purposes. The suit also asks $2,500 in damages “or such additional amount as may be proven at trial,” plus attorney’s fees and costs.
