Judge Shore Robertson ruled that while the case for distribution was not made, the Commonwealth did make its case for possession and intent. Marijuana was found in the bed of Martin’s truck and with the background evidence provided by the task force officers was compelling — Sullivan testified he saw Martin drop something into the bed of the truck when the police arrived on the scene. Since the charges were not stricken, Martin entered a plea of guilty. The jury was dismissed. The case was set for sentencing on Dec. 18.
