For the commission, two issues loom large on this application. First, there is the question of whether or not the original permit has a grandfathered status. This means that the original permit is still valid as long as terms and conditions required at the time of issuance were met, even though local ordinances have changed.

McCarthy, upon an initial investigation, had originally told Ms. Harris that the original permit was valid. However, he learned after the fact that a previous zoning administrator had ruled it invalid.

McCarthy therefore recommended that the original permit, which allowed for 35 trailer/RV sites, does not have a granfathered status. Ms. Harris plans to appeal that decision.

The second issue, which is affected somewhat by the first, has to do with county codes. Some residents felt that the capacity of 56 persons would violate local ordinances. This issue will be determined in part by the outcome of Ms. Harris’ appeal.

Due to the pending appeal, the commission felt that it was best to table the proposal until it is settled. Ms. Harris initially objected, but a number of board members commented that it would be in her best interest if they waited before acting on it. A motion to table the proposal was unanimously passed.
