Hazel River Tier III
Designation
The Board of Supervisors held a public hearing on the prospective designation of the Hazel River as an EPA tier 3 “Outstanding National Resource Water.” Janet S. Davis of Castleton, who said that she is not 8 riparian landowner but is active in environmental issues and stream water quality monitoring, urged the Board to support the designation. Edward Dorsey, also of Castleton, said that he does own land on the Hazel River in Culpeper and “doesn’t have a problem with tier 33.”
An opposing viewpoint was voiced by Deke Deacons, who said that he has 3/8 of a mile of frontage on the Thornton River. Mr. Deacons characterized himself as “tree-hugger,” but said even more he is an advocate for property rights, and he suggested that the tier 3 designation would lead to riparian property owners losing their rights. He suggested that the Board table any decision of the designation, and allow him time enough to more properly research the issue and convince the Board not to suppoit it.
The Board appeared to agree with Mr. Deacon’s contention that the designation would lead to a loss of rights-Mr. Welch even characterized the designation as a time bomb.
