Legislation pending in the Virginia General Assembly puts in question Rappahannock County’s ability, at the present time, to enact any ordinance that would establish standards and regulations for outdoor lighting.
At their February meeting, the Board of Supervisors, by Consensus, agreed with County Attorney Peter Luke that they await the results of General Assembly action before considering the County's draft ordinance. Senate Bill 100, passed by the Senate on -Jan 28 and currently in the House of Delegates for action “Grants all localities authority to establish, by ordinance, outdoor lighting standard^ and regulations for the purpose of controlling exterior illumination levels, incidence of glare, light trespass or urban sky-glow, or for the purpose of conserving energy."
The implication of this pending legislation is that localities do notnow have the authority to establish outdoor lighting ordinances, and Rappahannock’s proposed ordinance may not be enforceable, were it to be enacted by the Board of Supervisors.
The County’s lighting ordinance does continue to receive citizen comment though, the latest being a letter from Bob Ryan who writes of his support for what “is a modest proposal, without any great financial or personal burden to try and maintain an important part of what is special about Rappahannock.”
