The charge brought against Konick required proof that an obscene suggestion was made as well as proof that it was made “with intent to coerce, intimidate or harass.”
At the close of the trial, Judge Annie Lee Jacobs based her decision first on the credibility of Davis and Konick. Stuckmann called five separate witnesses for the defense to testify to Konick's reputation for truth.
