Using Davis’s testimony as her guide, Judge Jacobs found that by repeating the obscene suggestion after Davis' had asked if he had any court business, Konick had crossed a line.
Judge Jacobs stated that she might have believed Konick was joking “if conversation had stopped there. The only conclusion this court can draw is that he wanted to harass,” pronounced Jacobs.
“I categorically maintain my innocence and an appeal is likely, but no final decision has been made at this point in time,” Konick told the Rappahannock News after the trial.
