joined forces to remove Charles Eldred from the board, despite endorsements—in person and by petition—for the incumbent from Hampton District, and replaced him with Washington mayor and Rappahannock county planning commissioner J. Newbill Miller, likewise for an unexpired term of three years and one month.
Friday’s session came as a result of illegal actions taken by the trustees one year ago.
Last June, following a secret executive session, the electoral trustees named Eastham to a two-year term from Wakefield and Eldred to a four-year term from Hampton. They took no vote on either position, instead merely announcing their decisions.
The appointments were immediately challenged under provisions of Virginia's Freedom of Information Act and the challenges were supported by two opinions from the state Attorney General’s office, one dated October, 1979, and the second in March, 1980.
