Conflict Of Interest
The trustees were reminded of the actions of circuit court Judge Rayner V. Snead in filling vacancies on the electoral trustee board two years ago. At that time, Snead declined to reappoint George Muth solely on the grounds that - Muth’s membership on other local governing boards raised the possibility of conflict of interest charges.
Muth was a member of the Rappahannock board of zoning appeals while Newbill Miller is both a planning commissioner and mayor of the town of Washington, it was pointed out. If the possibility of conflict existed in Muth’s case, it certainly exists even more so in the case of Miller. Therefore, the trustees were asked to follow the example Judge Snead set in attempting to avoid even the appearance of conflict.
Turning to Commonwealth’s Attorney Douglas Baumgardner, Johnson verified that Miller’s appointment to the school board would not constitute a legal conflict of interest. 1 The trustees were reminded that George Muth’s continuance on the trustee board while also a member of the board of zoning appeals didn’t constitute a legal conflict either.
