The EPA Order also directed Culpeper Wood Preservers to submit a revised application for a RCRA permit for interim status within 30 days with information concerning the holding pond. If the company does not submit the application. it will have to go through a lengthy permitting procedure as a new hazardous waste facility or dispose of its waste at an authorized facility. The company had filed an application by the November 19, 1980 deadline, but that application did not mention the holding pond.

Before the surface impoundment can be used again for the storage of the chromium-arsenate solution, the site must come into compliance with all interim status standards for a hazardous waste facility, EPA told the company. These standards cover general operating requirements, the containment system, waste analysis, company inspections, closure procedures and other requirements for the handling of hazardous waste.
