Two Opposed Opinions
In the letter to Latham, however, Eastham maintained that Stone had given two "diametrically opposed" opinions.
Eastham quoted Stone as holding that the school board "is likely to have the authority to place schools, to revise them, and make appropriate changes to them, wherever they please as long as the conduct is rational."
He also quoted Stone is finding that "there is a reasonably good chance that the proper use of land and land planning would be one of those state policies which would be upheld as a reasonable restraint on the Constitutional power of schools." According to Eastham. Stone then added "his non-legal recommendation that the board go ahead and apply for the permit 'as a matter of good neighbor policy’ in the county."
