Commonwealth’s attorney Douglas Baumgardner interjected that he’d been requested by the circuit court judge to inquire about Rappahannock's jail situation.
“It’s serious,” Buntin replied. He reported that arrangements for housing three county prisoners will end this week. “I have no idea where we’ll put them. I’ll have to get on the phone and find some place.”
"We've been in this same situation for several months,” noted supervisor chairman J. R. Latham.
"Yes, but we’ve just been lucky,” Buntin countered. “I’ve got prisoners in four different places now. Anytime they say come and get them, we have no alternative." The sheriff expressed doubt as to whether the Department of Corrections would give permission for prisoners to be kept longer than 24 hours in Rappahannock’s lock-up. He added that he had housed one individual there for four or five days. "But if we got one that complained about it, he could sue us,” the sheriff said, noting that he was taking a chance in housing prisoners beyond the 24-hour limit and would only do so if the person involved was a local person whom he knew. "Is the judge willing to give you a court order to keep prisoners here?” asked Estes.
Baumgardner advised that the court lacked authority to overrule regulations set by the Department of Corrections which limit the Rappahannock facility to just a 24-hour lock-up. Repeating that construction can’t begin until the architect finishes specifications for bids, Buntin said he thought financing for the project has been settled. “Our part is going to be reimbursed,” supervisor Hubert Gilkey noted. At the sheriff's suggestion, Baumgardner agreed to relay an urgent message to Spencer, requesting that specifications be completed
