Jail Coverage
In another jail related matter, Clerk Diane Bruce reported that a consultant who had reviewed county insurance policies noted that it appears the jail has been dropped from liability coverage
“How long has the jail been dropped?" asked Estes.
“I don’t know and I don't know that it has been,” Bruce replied. She said that the consultant, referred by school board member Roben Eastham as interested in bidding on the comprehensive review of both the school board’s and supervisors’ coverage, found that the jail was not listed under the county’s general liability coverage. "The consultant said it could be covered on the sheriffs policy." she added.
Buntin asknowledged, however, that while a separate policy covers sheriffs department employees for liability, he doubted that it includes prisoners or visitors to the jail.
The matter of jail coverage came up in discussion of the county’s overall insurance protection.
Baumgardner told the board that constitutional officers and their deputies are considered county employees for the purpose of workmen’s compensation coverage, a question he’d been asked previously to resolve.
“There are more questions on our insurance that need to be answered as well,” Latham stated.
‘‘I recommend a comprehensive review of the county's insurance policies by someone trained to do the job,” Baumgardner advised. He noted that the sovereign immunity rule which applies to and protects counties and municipalities from suits is being eroded and “riddled with exceptions.”
By unanimous vote, the supervisors agreed to join with the county school board in securing independent consultant service for a review of insurance coverage.
