In a letter of opinion dated January 20, Robertson denied the Kidwell’s request for a permanent injunction. He held that the language of the deeds granting the 50 foot right-of-way through the lots shows an “unambiguous intent. ” Accordingly, this conclusion is not altered “so long as none of the intended uses exceed the 50 foot parameter of the right-of-way.”
