Writ <ef Certiorari was Lamed by Circuit Court Judge William Shore Robinson on October 18, and the BZA decision will be reviewed. In addition to a review of the decision, the application asked that additional evidence be taken, that evidence improperly, received by the BZA be excluded, that the evidence the BZA refbaed to accept be included, and that the decision be reversed with costs being allowed against the BZA.
"We have to appeal because they put a cloud on my house by saying that they’d let me go for now,” SaltonstaU said. “That doesn’t say what they might do next year, and if I ever wanted to sell the house there would be that cloud over it so that cloud has to be cleared.” The BZA decision had been referred to the Board of Supervisors for enforcement, and the board decided that the house could be used as long as it continued to house one family and no other buildings of its kind would be allowed.
“As far as I’m concerned, she (Saltons tall) is exercising the right that the ordinance gives her to appal oar derision to the court,” said Lee Bird, chairman of the Board of Zoning Appeals. “There were two sides, and in approaching the matter we tried to be fair and impartial in reaching our judgment.”
