Diane E. Kidwell of Flint Hill filed a $225,000 lawsuit against David L. Konick, a Washington, Va. lawyer, on October 18.
Kidwell asks in the suit for an award of $75,000 in compensatory damages, and $150,000 in exemplary damages on a series of grounds that refer back to a period from September to November, 1982. During that time, Konick was representing the Kidwells in a right-of-way dispute with Patricia Sal tons tall of Points of View Farm, Flint Hill.
On November 9, 1982, the foreman of Points of View Farm, Ranee Spellman, was shot by Kidwell in a dispute over the widening of a road. Kidwell was indicted for murder in December of 1982, and found not guilty by reason of self defense in October, 1983.
The suit alleges that after the shooting, Kidwell sought advice from Konick, and that his actions were not in keeping with the lawyer/client relationship. Grounds for the suit include allegations that Konick “sought to suppress material evidence in con
