Charges Placed
WOODSTOCK — Winchester lawyer E. Eugene Gunter, a former Frederick County commonwealth’s attorney and former Winchester police officer Dennis B. Sirbaugh were indicted on illegal wiretapping charges Wednesday.
The Shenandoah County grand jury indicted both men on charges of conspiring to place a wiretap and Sirbaugh on an additional charge of placing a wiretap. Neither entered a plea Wednesday.
The cases have been continued until the Supreme Court of Virginia can appoint a judge to hear them. Circuit Judge Perry Sarver disqualified himself from hearing the cases.
iJunter, 50, said Tuesday the in dictments are related to a divorce cast he has been handling in Shenandoah County.
“I do not feel that I’ve done anything wrong ... but obviously someone disagrees with me,” he said.
Gunter said recordings were made of telephone conversations of the husband in the case, but he said he does not believe recordings made from a home phone — even if they are done without the knowledge of the persor being recorded — are illegal.
He said he offered to make his files in the divorce case available to Statt Police investigators but the offer was declined.
Sirbaugh, 32, who has worked fo Gunter as a private investigator, re signed from the Winchester Police De partment in June 1984.
Illegal wiretapping in Virginia is ; felony that carries a maximum punish ment of five years in prison. It is also federal offense.
