At a special joint meeting last Thursday, Rappahannock’s supervisors promised to assume defense costs in the event of a suit against the county’s Water and Sewer Authority in the absence of public officials’ liability coverage. The board took that position despite questions over its own liability policy, which has apparently been sold to a Chicago firm by the original underwriter, Markel Services, Inc.

A representative of Markel Services reported two weeks ago that the WSA was not included in the county’s public officials liability coverage. The news prompted a request from the Authority members that the supervisors cover both defense costs and any judgements against the WSA in the interim until coverage to protect them as individuals is secured. Douglas Baumgardner, the Authority’s attorney, was also directed to review the WSA’s general coverage already in place as a rider on the county’s policy.

“I have not been successful in getting a copy of that policy,” Mr. Baumgardner told the Authority members and three supervisors at last Thursday’s emergency session.
