Mr. Baumgardner added that a second representative from Markel, the insurance company that originally assumed the board’s public officials liability coverage, told him last week that “normally, under a public officials liability policy, when the county is named as insured, coverage is deemed to include any sewer or water authority.”
Authority members are considered to be under the control of the Board of Supervisors because they are appointed by the board and can only undertake those projects authorized by the governing body, he added. “So it may be we have full coverage,” Mr. Baumgardner said, adding that the insurance company was to give him a definitive answer by Monday.
But according to the county’s insurance consultant, public officials liability for the WSA “is not essential coverage,” Mr. Baumgardner continued. The county’s insurance consultant recommended that if public officials liability for the Authority members “costs more than $10 per annum, don’t get it.” Claims normally covered under a policy of that type involve wrongful termination of employment on the basis of sexual or racial discrimination, according to the consultant. “He doesn’t know of a single claim like that being filed in
