He said that the town’s zoning ordinance defined a lot as a parcel of land either shown on a plat of record or considered a lot for tax purposes.
Mr. Miller said he had been paying taxes on it as a separate lot since he bought it in 1968.
Mr. Reynolds agreed that if Mr. Miller has been paying taxes on a separate lot, he Has ownership of the property as a separate lot.
“I don’t understand,” Mr. Miller said. “If you wanted to know why not ask me. Who brought this up to Mr. McCarthy?”
“I did,” Mr. Gooch said. “My concern was my own lot and my Gay Street right of way. The attorney who researched my title had a question about Gay Street. When you surveyed the land, I figured you were doing it for a purpose. He said that an attorney who had earlier researched the issue felt the lot had been merged with Mr. Miller’s house lot.”
“It was taxed as a lot before I got it. It was there when I got it,” Mr. Miller said. “I knew you were going to say something to John about it so I asked John if I could do it, and he said, ‘Yes, you can.’”
“How can you say your lot is that one-half acre lot?” Mr. Gooch asked.
“I didn’t say anything about that,” Mr. Miller answered.
“If I were creating a lot, I could be challenged,” Mr. Gooch said.
“I’m not going to let a hostile situation take one of my rights away from me,” Mr. Miller said.
Mr. Reynolds said he had brought the issue to the council because it could come up again and that the council should consider establishing exactly where its streets are. No action was taken on his suggestion.
A check with Commissioner of Revenue Beverly Atkins showed that the parcel has been taxed as a separate lot since at least 1952, which is far back as her records go.
